Actor Charlie Sheen has been awarded sole custody of his 14-year-old twin sons, who he shares with ex-wife Brooke Mueller, if she fails a drug test. This decision was made by the Los Angeles County Superior Court based on an ex parte motion filed by Sheen. The court order states that Mueller will lose custody and visitation rights immediately if she tests positive for drugs or alcohol.
The former couple had previously agreed to these conditions out of court in November 2022 and August 2023. It is unclear what led to the filing of the ex parte motion. A representative for Mueller declined to comment on the matter, while Sheen’s lawyer stated that his client had no comment.
Currently, Sheen and Mueller have joint legal custody of their sons, but the primary residence is with Sheen. The court order ensures that if Mueller fails a drug test, Sheen will have sole custody of their children.
According to documents filed in November 2022, Sheen would immediately be granted sole custody of their children, Max and Bob, if Mueller tests positive for drugs or alcohol. The documents also specify that Mueller must comply with drug and alcohol testing as required by her probation officer, at the request of Sheen or his attorney, and at least once a week.
Mueller allegedly relapsed in the summer of 2023, as stated in the August 2023 document related to the previously agreed child custody orders. Sheen and Mueller finalized their divorce in 2011.
Both Sheen and Mueller have struggled with addiction. Sheen has a history of arrests in domestic violence cases and has spent time in rehab. In 2011, his twins were temporarily removed from his home after allegations of violence by Mueller. Mueller, on the other hand, was sentenced to probation in 2012 after being involved in an altercation and having cocaine in her possession.
It remains to be seen how this custody arrangement will unfold, but for now, Sheen has been granted sole custody if Mueller fails the drug test.
